These Terms of Use ("Terms") govern your use of the Kawaii Emoji Battery Android application ("the App"), package name com.sparkbyte.emojibattery, provided by the developer ("we", "us", "our"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. License Grant
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Android devices that you own or control, solely for your personal, non-commercial use, and in accordance with these Terms and the Google Play Terms of Service.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. By using the App, you represent that you meet this requirement.
3. Pricing & Advertising
The App is free to download and use and is supported by advertising. The App does not currently offer in-app purchases or subscriptions. Ads are served through third-party networks as described in our Privacy Policy. If in-app purchases are added in the future, they will be processed through Google Play Billing and these Terms will be updated accordingly.
4. Acceptable Use
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except where permitted by law.
- Copy, modify, distribute, sell, rent, sublicense or resell any part of the App.
- Use the App for any unlawful purpose or to infringe the rights of others.
- Circumvent, disable or interfere with security or advertising features of the App.
- Use automated means to access or interact with the App in a way that disrupts its operation.
5. Your Content & Customizations
You retain ownership of any content you create or customizations you configure within the App. Customization data is stored locally on your device; you are responsible for backing it up. We are not responsible for any loss of locally stored settings, including following an uninstall or device reset.
6. Intellectual Property
The App, including its emoji designs, stickers, themes, graphics, code and trademarks, is owned by us or our licensors and is protected by intellectual property laws. No rights are granted to you except as expressly set out in these Terms.
7. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or compatible with every device. Battery-related visuals are decorative and may not exactly reflect your device's actual battery state.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. Our total aggregate liability shall not exceed the greater of the amount you paid us in the 12 months preceding the claim or USD 10.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses or expenses (including reasonable legal fees) arising from your misuse of the App or violation of these Terms.
10. Termination
These Terms remain in effect while you use the App. We may suspend or terminate your license at any time if you breach these Terms. You may terminate by uninstalling the App. Sections that by their nature should survive termination (e.g. Disclaimers, Limitation of Liability, Indemnification) will continue to apply.
11. Google Play Distribution
The App is distributed via Google Play. You acknowledge that these Terms are between you and the developer only, and not with Google. Google is not responsible for the App or its content. Your use of the App must also comply with the Google Play Terms of Service and the Google Privacy Policy. You agree to comply with all applicable laws, including U.S. export-control laws.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which the developer is established, without regard to conflict-of-laws principles. Mandatory consumer-protection rights in your country of residence are unaffected.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced through an in-app notice and/or the Google Play release notes, and the "Last updated" date above will be revised. Continued use of the App after changes take effect constitutes acceptance.
